Consumer Health Data Privacy Policy

This policy applies specifically to consumer health data, as defined by the Washington My Health My Data Act and the Nevada Consumer Health Data Privacy Law. It is separate from our general Privacy Policy.

Scope of this policy

This policy describes how Personal Injury Trauma Therapy collects, uses, shares, and protects consumer health data — information linked or reasonably linkable to a consumer that identifies their past, present, or future physical or mental health status. It is provided under the Washington My Health My Data Act (RCW 19.373) and the Nevada Consumer Health Data Privacy Law (SB 370).

This policy does notcover protected health information (“PHI”) governed by HIPAA, information governed by other federal or state health privacy laws, or de-identified data. PHI created in the course of your clinical care is handled under HIPAA and the Notice of Privacy Practices you receive when care begins. Categories of consumer health data we collect

Because this website is about trauma therapy, some ordinary website activity can itself signal health status. We treat the following as consumer health data:

  • Information you volunteer when requesting an appointment or contacting us — for example that you were injured in an accident, the symptoms you describe, or that you are seeking therapy.
  • Information a referring attorney or medical provider submits about a person they are referring to us.
  • Information indicating that you are seeking, have sought, or have received mental health treatment.
  • Information you provide about a personal-injury claim to the extent it relates to a physical or mental health condition.
  • If — and only if — you agree to analytics: the fact that your device viewed a page about a specific condition, together with the technical identifiers the analytics tools collect. Because our page addresses name conditions, we treat that as consumer health data rather than as ordinary website analytics.

Analytics and your consent

We do not load analytics when you arrive. Before Google Analytics 4 or Microsoft Clarity runs, we ask you, and nothing loads unless you agree. If your browser sends a Global Privacy Control signal we treat that as a refusal and do not ask.

If you agree, that agreement is your consent to our collection of this category of consumer health data and to sharing it with those two providers for the sole purpose of measuring and improving this website. You can withdraw it at any time by clearing this site's data in your browser, which makes us ask again, or by emailing us. Declining or withdrawing has no effect on the care you receive, and we never use analytics data for clinical purposes or to make decisions about your care.

Sources of consumer health data

  • Directly from you, through forms on this website or by phone or email.
  • From referring attorneys, medical providers, or others who submit a referral on your behalf.
  • From the service providers that operate our intake forms and communications, acting on our instructions.

Why we collect it

  • To respond to your request and determine whether we can help.
  • To confirm we are licensed in your state and can lawfully provide telehealth care to you.
  • To schedule an appointment and complete intake.
  • To coordinate lien or letter-of-protection arrangements where you have asked us to.
  • To meet legal, regulatory, and professional obligations.

We do not sell consumer health data, and we do not use it for behavioral advertising.

Who we share it with

We share consumer health data only as needed to deliver the service you asked for, and only with:

  • Our clinicians and administrative staff, to respond to your request and provide care.
  • Service providers acting on our behalf under written agreements that restrict their use of the data — currently our practice-management and client-portal platform (SimplePractice), our intake form and communications platform (GoHighLevel), our website host (Vercel), and our email provider.
  • Google and Microsoft, but only where you have agreed to analytics, and only for website measurement — see the analytics section above. IP anonymization is enabled and advertising features are turned off, so this is not used to build advertising profiles.
  • People you direct us to, such as your attorney or a referring provider, with your authorization.
  • Authorities or parties where required by law, or where necessary to prevent serious harm.

We do not share consumer health data with affiliates, because we have none.

Your rights

If you are a Washington or Nevada resident, you have the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data, and access that data.
  • Know the list of third parties with whom we have shared it, and contact information for each.
  • Withdraw consent to our collection and sharing of it.
  • Delete your consumer health data, subject to the record retention we are required to maintain by law and by professional licensing rules.

To exercise any of these rights, email info@personalinjurytraumatherapy.com or call (470) 836-4878 and tell us which right you want to exercise. We will verify your identity before acting, respond within the timeframe the law requires, and will not discriminate against you for making a request.

If we deny your request, you may appeal by replying to our response. If the appeal is denied, Washington residents may contact the Washington State Attorney General and Nevada residents may contact the Nevada Attorney General.

How we protect it

We limit access to consumer health data to the people who need it, use vendors that support HIPAA obligations under written agreements, and apply administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No system is perfectly secure, and we cannot guarantee absolute security.
